Professional Regulation and Criminal Liability Paper Essay The principle of the Hippocratic Oath is one of the oldest binding documents in history. The oath states: I will use those dietary regimens which will benefit my patients according to my greatest ability and judgment, and I will do no harm or injustice to them. I will not give a lethal drug to anyone if I am asked, nor will I advise such a plan; and similarly I will not give a woman a pessary to cause an abortion. In purity and according to divine law will I carry out my life and my art. I will not use the knife, even upon those suffering from stones, but I will leave this to those who are trained in this craft. Into whatever homes I go, I will enter them for the benefit of the sick, avoiding any voluntary act of impropriety or corruption, including the seduction of women or men, whether they are free men or slaves. Whatever I see or hear in the lives of my patients, whether in connection with my professional practice or not, which ought not to be spoken of outside, I will keep secret, as considering all such things to be private. So long as I maintain this Oath faithfully and without corruption, may it be granted to me to partake of life fully and the practice of my art, gaining the respect of all men for all time. However, should I transgress this Oath and violate it, may the opposite be my fate. (U.S. National Library of Medicine, 2014) Medical Board of California The Medical Board of California is the agency responsible for regulating physicians, surgeons and other allied health professions. The members of the board are appointed by the Governor of the state and have a four year term legislature. It is the responsibility of the members of the board to meet as one deliberating body. In addition, the board members are required to learn about policies and statutes of both licensing and enforcement functions. California Licensure Physician Statute There is no single physician licensure statute in the state of California. Instead, physician licensure rules have been interspersed within the California code. Physicians wishing to practice medicine in California are required to obtain a full medical license issued by the state. Furthermore, there are no administrative regulations or state statue for granting a  special or limited license to practice in the state remotely via telemedicine. The California licensure does not allow for license reciprocity between any states but allows physicians for consultative services without having to receive a full medical licensure. Moreover, licensed physicians in the military in any of the states, either a military physician officer or a civilian contract employee, are allowed to care for fellow military members without having to receive additional licensure. In the event of an emergency situation, a physician is allowed to administer care regardless if the physician is licensed in that part icular state. A physical examination is required by the California Medical Board Licensure to allow administration or prescription of medication over the internet. Investigative Role The investigative team consists of physicians that are a critical component to the board as they base its disciplinary actions on the opinions of physicians and not board staff. Physicians play a distinct role in the investigations. The board receives and reviews incoming complaints in the Central Complaint Unit (CCU). The physicians determine if there is a need for formal investigation by board investigative staff or if the complaint is largely resolved by a preliminary review of the medical records and the accompanying physician narrative statement. Medical experts are asked to review case materials and must clearly articulate whether the physicians care under review fell below the standard. They must give their opinion if there is a potential violation of the Medical Practice Act. Business and Professions Code Section 2050-2079 According to the Federation of State Medical Boards, the 10th Amendment police power grants states the right to regulate the practice of medicine. Section 2052 of the Business and Professions Code states that any person who practices or attempts to practice, or who advertises or holds himself or herself out as practicing, any system or mode of treating the sick or afflicted in this state, or who diagnoses, treats, operates for, or prescribes for any ailment, blemish, deformity, disease, disfigurement, disorder, injury, or other physical or mental condition of any person, without having at the time of so doing a valid, unrevoked, or unsuspended  certificate as provided in this chapter or without being authorized to perform the act pursuant to a certificate obtained in accordance with some other provision of law is guilty of a public offense, punishable by a fine not exceeding ten thousand dollars ($10,000), by imprisonment pursuant to subdivision of Section 1170 of the Penal Code, b y imprisonment in a county jail not exceeding one year, or by both the fine and either imprisonment (California Business and Professions Code, 2014). Civil Complaint Process The two major categories of incoming complaints to the Medical Care Board of California by the consumers are quality of care and personal conduct. All complaints require physician review and all complaints which are not closed by CCU staff are referred to one of the boards district offices for formal investigation. According to the Medical Board, each district office is staffed with a supervising investigator, five investigators, a deputy attorney general, an investigator assistant, clerical support staff and one or more medical consultants (The Medical Board of California, 2014). Risk Management Quality Assurance It is important that physicians are credentialed and are given privileges in any health care organization prior to practicing medicine. Physicians must receive training and education in risk management and review of federal and state regulations mandates. A successful risk management strategy is to improve the quality of patient care and reduce the probability of an adverse outcome or a medical malpractice claim. Its objective is to reduce the risk to patients and liability to the physician. Furthermore, the foundation for risk management is the standard of care. Tracking the quality of care of physicians must include Ongoing Professional Practice Evaluations (OPPE) and a peer review committee within an organization. Criminal Prosecution for Malpractice Physicians are in a unique position in regard to the law by the nature of their work. A physician may face a charge of criminal negligence, manslaughter, or second-degree murder if a patient in his care suffers severe or lethal injuries. â€Å"Negligence law offers plaintiffs the legal framework upon which to build their civil suit. A plaintiff in a medical  malpractice action must satisfy four elements-duty, breach, causation and damage- in order to prevail. In a negligence case, the wrongdoers actions are compared to what would be expected of a reasonable and prudent person in the same or similar circumstance† (Monico, Kulkarni, Calise, 2013). The practice of medicine is full of uncertainties. In some cases, bad outcome is the result of physician negligence. The patient and/or his family may institute a civil suit for malpractice if they believe that the bad outcome was a result of the physician’s actions. It is very rare that a prosecutor decides the facts of a ca se warrant a charge of criminal malpractice. The prosecutors must see a repetitive negligent behavior that constitutes to a pattern that can be documented before criminal charges can be filed. Conclusion The medical profession has many dedicated people who give themselves and sacrifices for the sake of saving lives. Physicians practice their profession according to the Hippocratic Oath. Furthermore, the have learned the rules and regulations mandated by the Federal and State government in health care delivery. Quality of health care is an important objective of CMS. Physicians are required to adhere to the standards of quality care and the delivery of it. When physicians get in trouble with the law, they have to face various criminal and civil charges based on the severity of their case. In the current trend, doctors commit white-collar crimes when they take kickbacks, order questionable procedures, overbill patients and insurance companies, and bill for services they did not provide. The Medical Board of California ensures safety and protection of health care consumers through proper licensing and regulation of physicians by means of various objective enforcement of the Medical Practice Act. Conflict Resolution In Civil Engineering Construction Industry Introduction Conflict exists in society generally, includes in family, work and so on. It is important and necessary to resolve all kinds of conflicts efficiently and successfully. Inevitably, conflict is also a reality in the civil engineering construction industry. It influences the operation of projects, increases the cost of projects, wastes various resources, delays the duration of engineering, decreases staff motivation. Conflict has become a serious problem in the civil engineering construction industry (Davies, 1998). Conflict resolution becomes more and more useful and crucial. There are four objectives in the report: define the concepts of conflict and construction industry, expound the significance of conflict resolution, investigate the reasons of causing conflicts and recommend some methods to resolve conflicts. Methodology In the report, there are four main objectives. There are three main steps to accomplish the objectives. The inductive approach is used in the report. Firstly, finding out the key words of the report topic, it is necessary to read some books, journals, periodicals and articles from library and websites. People could understand the concept of conflict, the significance of conflict resolution, reason of causing conflicts and how to resolve conflicts. Secondly, according to the knowledge, author could define concepts, understand different opinions from different writers and analyze the different opinions. Thirdly, after studying and pondering, author expounds her own ideas of the four objectives. Literature review The definition of conflict is that the process of cooperation is incompatible and unfavorable (Rahim, 1992). It is universal and exists with incompatible cooperation (Davies, 1998). Conflict exists in all more than one personal work environment. It is people used to considering their own interest rather than others (Humphrey, 2008). Hellard (1992) thought that conflict is not only caused by a train of events. Peoples emotions could involve in the events and influence the causing of conflicts inevitably. The civil engineering construction industry needs many professional people to involve in, such as Architects, Structure Designers, Constructors, Building and Quantity Surveyors and so on. There are some kinds of conflicts in building industry, Zikmann (1992, p55) said that these include â€Å"interest conflicts, structural conflicts, value conflicts, relationship conflicts and data conflicts†. Conflicts occur commonly between main contractors and the sub-contractors (Harding, 1991; as quoted in Langford, 1992). Not only have that, but conflict also occurred between contractors and clients, or contractors and clients architects. Some elements, such as project types and sizes, procurement systems and government policy, could influence the conflict aspects (Lavers, 1992). Effectively managed conflicts are necessary. It requires that the construction managers have enough abilities to resolve conflicts. The reason of causing conflicts is various. The majority of conflicts are developed because these are not responded correctly and timely. On the contrary, poor managed conflicts could deteriorate the issues (Zikmann, 1992). There are some reasons of causing conflicts in construction industry. Some are because the construction plan is not clear. It confuses both client and contractor. Some are because over-scope of task between contractor and his subcontractors. The contractor requires subcontractors to do extra work. Some are because time is not enough to complete the project. Others are because the client asks for extra work but refuse to pay more money and extend the time of completion (Klinger, 2009). Contingency is another reason of causing conflicts. In construction industry, the roles of every part could change. It means that in the new environment, there are some barriers to influence relationship balance (Langford, 1992). It is a key ability for managers to manage the complicated relationship networks of project which is limited time and budget (Zikmann, 1992). Dispute avoidance is useful in construction management. Conflicts are often caused by wrong consideration, inadequate preparatory and plan or poor project procedures and budget. The popular ways to avoid conflicts are early negotiation, risk audits and training (Brewer, 2007). The best way to resolve conflicts is prevention. It requires project managers to acquaint the objectives of client, make reasonable project plan and have the ability of prediction. People can pinpoint the reason of causing conflicts before happening, but it is difficult to predict when the conflict will occur. Therefore, the certainty of predicting conflicts at the beginning and end is less than in a construction project (Cree, 1992). Not only prediction, but also communication could help to resolve conflicts. Poor communication could cause misunderstanding (Mackie, 1992). Follett(1940, as quoted in Rahim, 1992) said that there are some mains to resolve conflicts, such as domination, compromise, consolidation, avoidance and suppression. Fenn (1992) said that the new method to resolve conflicts is alternatives of litigation and arbitration. KuTenk (2000) classified the strategy of conflict resolution into three parts, avoidance, diffusion and antagonism. It is the method to resolve general conflicts and problems. It lacks of pertinence for construction industry. For construction industry, managers need the ability to negotiate to resolve conflicts (Jambro and Siddiqi, 2008). Negotiation is the most common method to resolve conflicts. It is more flexible, economic and efficient than other methods (Dieterle and Ramirez, 2001). Mediation could assist negotiation. Parties select a mediator to help them resolve the conflicts. Mediators could assist all parties to resolve but they have no right to compel any party to agree (Goodman, 2006). Arbitration was the favored method to resolve conflicts in 1980s and 1990s. It is efficient and economical. Litigation is resolution of conflicts in the court. It is a long and expensive process (Klinger, 2009). Dispute review board (DRB) is build before starting of construction. Mostly, it is composed by three construction professionals who have abundant experience. It is highly effective and could reduce the cost of dispute resolution. Over 70% people thought DRB is better than arbitration about resolution result (Harmon, 2003-2004). The conflict resolution in England and Wales has some methods. It is divided into two parts: non-binding and binding. In non-binding, there are conciliation, executive tribunal and mediation. In binding, there are adjudication, arbitration, expert determination, litigation and so on (Davies, 1998). Discussion Conflict is a kind of phenomenon which exists in everywhere commonly in the society. Every person has their own ideas, standpoint and interest, it is impossible to unify all ideas of all people. Therefore, the existing of conflicts is automatic consequence. Especially in civil engineering construction industry, there are so many people, roles and tasks, complicated relationship and interested parties. The conflict usually occurs between client or designer and contractor, contractor and subcontractors, contractor and workers or worker and worker. Any relationship is very important and could become the key point to influence the whole project. Good conflict resolution could bring high efficiency and more profit. Bad conflict resolution hinders the smooth process of construction project. The reasons of causing conflict are very various and complicated. These could be summarized into four types: time, money, task allocation and contingency. Time means that the project could not be completed on time. In consequence of the changes of design, unreasonable plan in construction stage, works programme are delayed. The kind of conflict often occurs between client or designer and contactor. The conflict is caused by money includes contractor does not gain money from client, contractor refuses to pay wages to workers, poor financial budget, material price fluctuation. Task allocation reason means that the project plan is poor, the assignment allocation is ambiguous, task allocation is unfair, harsh work environment and so on. Contingency is an uncertain element but exists generally and inevitable. It could be occurred in every aspect. Contingency usually can not be dealt with in time because of indeterminacy. Conflict likes a barrier for construction industry. Conflict resolution becomes more and more important. Domination and suppression are unacceptable methods. These methods could cause more serious conflicts. Four steps method could be used to resolve problems about conflicts when people manage a construction project. First step is to prevent. Prevention could resolve conflict before occurring. Good conflict prevention needs excellent managers who have enough abilities to make project time and cost plan sensibly, manage all kinds of relationships well and arrange tasks reasonably. Everyone take his due responsibility and obligation. It is the best way of resolving conflict to minimize the probability of causing conflicts. Second step is to establish a group which includes some experts who have extensive experience. These experts could make use of their experience to resolve a lot of contingencies as soon as possible and avoid the conflicts are deteriorated by their experience. Not only that, they also can give some good advice to resolve conflicts in other steps. Third step is to negotiate. Negotiation is an effective and economical method to resolve conflict. Conflict is the problem of two or more parties rather than only one party. So it is important to have good communication and good relationship between every party. Negotiation is a good way to communicate with every party. People could get the main reason of causing conflict and discuss the best way which every party can accept to resolve conflicts. Conflict could be resolved as soon as possible and avoid be deteriorated. Mediation is another way to negotiate between parties. It needs a mediator who selected by every party to help them to resolve conflicts. Negotiation could resolve conflict without breaking relationships. It is a double win method to resolve conflict between parties. Fourth step is arbitration or litigation. These are the resolution process in court. The differences are litigation needs discovery or jury and allows appealing. The process of arbitration or litigation is very long and takes a lot of money. It means that people spend long time and increase the cost of project but conflict is not always be resolved well. Do not use the step if conflict could be resolve by the first three steps. Conclusion Conflict is occurred between different people or interest parties. In civil engineering construction industry, client, contractor, subcontractor and worker are four main component parts. Conflict likes a barrier to baffle the entire project. It is important to deal with and resolve conflict. There are four main reasons of causing conflict, time, money, task allocation and contingency. Good managers and reasonable approaches are necessary for conflict resolution. Prevention, expert group, negotiation and arbitration are four steps to resolve conflicts. Procedure: I am going to collect relevant material of these two by using internet and textbooks. FINDINGS: I have chosen two contrasting organizations TESCO and Oxfam. Tesco is a shopping mart where we can purchase our essential things. It can also be define as a global grocery and general merchandising vendor headquartered in UK. Sir Jack Cohen founded Tesco in 1919, when he began to sell extra food stuff from a stall in the East End of London. Tesco first appeared above a shop in Edgware in 1929 and since then the company has grown and developed. Tesco is the third largest retailer in the world measured by income Tesco private limited corporation (PLC) is the biggest super mart in UK which has 29% of shares in market compared to other companies like asda which has 17% shares in market. PLC private limited company and dont allow its shares for sale publically. Plc company makes profit more than public companies. A Plc company has no limits of share and share capital and there is no limit to the members liability because there is no limitation on members liability Purpose of Tesco is to make money and invest and sale quality products. And provide reliable materials to consumers. Why do Tesco exist? Tesco exist to provide the goods and services that people and earning money and profits from business .it provides jobs for people the Tesco provides daily need products . Products that customers demand like food, clothes, Home electircs,Sound and vision ,Bed and bath, Furniture and kitchen, Clothing and jewellery, Toys and gift, Baby and toddlers, Garden needs. Products and services supplied at profit, at cost and below cost. Tesco is getting profit by introducing new brands and also selling goods at lease.tehy are getting profit on products by supplying them to other countries and at whole sale. They can sell products by introducing off packages to customers at low prices for a specific duration which means to make them as a regular customers to gain profit in future. And also out of seasons sale which shows selling at low cost. Objectives of TESCO are as tesco is UKs finest food retailers having 519 stores in England, Wales, and Scotland. And 105 stores in France managed by wine producer and 44 in Hungary managed by international. Tesco offers best reasonable prices. Tesco meets the need of customers opinions regarding advance product quality, choice, store facilities and service Tesco is the main profitable investment with progressive return. Tesco is introducing young talents and sound management of workers and training practices and giving job on marit basis not by personal relations.Tesco maintaining its relationships with product makers supplier on quality and price criteria. Tesco is co operating on making of food in industry. also Providing good environment and protection. Ownership can be defined as Employee or executive who has the principle responsibility for a business, or project The public sector in this type of ownership only British people can get ownership in Tesco to gain profit. Sole Traders controlled and financed by one person. Least expensive form of ownership to organize. Sole proprietors receive all income generated by the business to keep or reinvest. Partnerships contains 2 -20 members who share their assets and profits from business. Public Limited Companies (PLCs) shares to the general public it contains Minimum of 2 but no maximum number of shareholders Private Limited Companies contains financed and controlled by between 2 and 50 shareholders. Franchises .A business which has bought the right to trade under established name in different cities.e.g McDonalds, KFC. Co-operatives it contains Groups of people who enter business and share the benefits customers Co-operatives, Producer Co-operatives, Worker Co-operatives. Charitable trust for helping famines and collect funds from rich .and also receives funds from GOVT. OXFAM It is a trouble reliever organization which includes 14 countries organization with 3,000 partners in around 100 countries to decrease poverty and injustice .It can be define as an International organization which helps and provide training and financial aid to people in developing countries and disaster areas. A UK based organization which was established in the 1942. Oxfam is campaigns, development program and emergency response by co operation of internationally connected associations. Oxfam international was formed in 1995 by an independent non government organization. Development Works with local partner organization And helps poor and poverty. And realizing People Their rights e.g. education, health Emergency Oxfam provides life saving aids during Emergency and help people for Future Crises Campaigning Putting the pressure on leaders to make long lasting change Oxfam International is group of 13 independent association contains Germany Australia, Belgium, Canada, France, , Great Britain, New Zealand, Hong Kong, Ireland, The Netherlands, Quebec, Spain and the United States. Objectives of OXFAM: Relieve suffering caused by natural disasters.Oxfam supports peace and understanding based upon mutual tolerance and respect. Strengthen peoples capacity to help them. Oxfam works for trade justice, fair trade, education and aid, health, HIV/AIDS, conflict ,campaigning and natural disasters, human rights, and climate change. Oxfams International purpose. The main purposes of Oxfam are Promote, assist and manage relationship between the Oxfam international to do help all disasterd people globall.and earning name at international level And removing poverty OXFAM has its committee in different countries which are as under Oxfam GB (Great Britain) .Oxfam Canada.Oxfam America. TESCO Stakeholder Stakeholder can be defined as a person, group or organization that has direct and indirect position in organization. It is affected by organizations rules, polices and decisions. Tesco has many stakeholders. Government, Customers, Employees, Local Community, Suppliers, and Pressure Groups: they all have equal importance in building of Tesco Customers. Usually a customer wants quality goods at a low cost. John â€Å"Jack† Griffith London, a twentieth century author, wrote The Call of the Wild, other novels, and short stories that depict the philosophical views of the time and added adventure to them by using his own life experiences that carried thousands of men including himself to the Klondike in search of gold.   Ã‚  Ã‚  Ã‚  Ã‚   In Winter 1876 San Francisco John and Flora London shared the joy of childbirth in the celebration of their only child together. They named the baby boy John Griffith London, or Jack for short. He became the twelfth child of his father, for through his first marriage he had eleven children. Jack London’s family was stricken by poverty. His father had many trades, however worked mainly in truck gardening(McCracken 370). After Jack’s graduation from grammar school, which he attended in Oakland, Jack read many novels, mainly ones about romance, travel, and adventure. His first writing, a story about life on the Yukon, was accepted by a magazine called Overlan... ...ty. This is illustrated in a quote from the book, â€Å"His cunning was wolf cunning...his intelligence, shepherd intelligence and St. Bernard intelligence.†(London) â€Å"London’s unusual subject allows him to see virtues in return to an aboriginal state that could not be found if humans were the subject.†(Magill 1148) He also uses the literary element of contrast to bring effect to his novel. For instance when â€Å"Buck is at his most savage he is also most completely fulfilling his potential utulizing his brain, muscles, and heart to the utmost.†(Magill 1148)   Ã‚  Ã‚  Ã‚  Ã‚  Jack London had a life full of ups and downs . He used ideas of philosophy that affected the world to inspire all of his writings as well as the ideas of his own experiences and of the great adventures celebrated in the age of time. He used ideas of Charles Darwin, racial hierarchy, and the American Credo of success to inspire his writings. Once he tried to make it to Alaska himself, so he was able to use some of what he experienced to add realistic adventure to his stories. All elements of his life and his era helped make him one of the greatest adventure writers of the generations.

Curlys Wife--of Mice And Men :: essays research papers

Curley’s wife in Of Mice and Men is given a fairly one-dimensional portrayal throughout the novella, as her character stays, for the most part, enigmatic. The most obvious example would be her lack of a name. She is continually referred to as a possession of her husband and without a name she becomes almost insignificant. The author, however, drops hints throughout the book telling his audience that there may be more to Curley’s wife than what is easily deduced.   Ã‚  Ã‚  Ã‚  Ã‚  One scene involving a sympathetic portrayal of Curley’s wife is when she is looking for Curley in Crooks’ quarters after Lennie and Candy enter. She knows where Curley and the rest of the men have gone, and grows angry at the cold treatment she is given by the three men in the room. Curley’s wife confesses her loneliness of being stuck in the house all the time and to not liking Curley’s company. She becomes even more angry about the lie of the circumstances of Curley’s hand injury and it is now obvious that her and Curley’s relationship is extremely dysfunctional and probably emotionally damaging to the wife.   Ã‚  Ã‚  Ã‚  Ã‚  Another important scene in which Curley’s wife is portrayed in a sympathetic manner is during her conversation with Lennie before her death. She confesses to Lennie that she dislikes Curley because he is angry all the time and says that she comes around because she is lonely and just wants someone to talk to. She speaks to Lennie not because she specifically cares for him, but because she lacks human interaction. Like George and Lennie, she once had a dream she sought for, of becoming an actress and living in Hollywood.

The composition of this advertisement is only a concept version of the iPhone. It is showing only the back of the iPhone, which gives a different perspective of the main product which makes viewers want to learn more. The color palette of this advertisement consists of mostly dark colors with the print being in white.There is bold print that says, â€Å"Touching is believing†, this statement is bold to show the slogan of the advertisement. The advertiser uses the contrast of the black and white colors to give emphasis to the slogan, which could be the focal point of the picture. The black color maybe gives the sense that the product has great innovation. The viewer can clearly see the Apple logo and knows that the product is made with good quality. InterpretationThis advertisement could be trying to show how different apple is than other companies in terms of being innovative. Is India Still Developing Country Essay

Even after 66 years of independence, India is still labeled as a developing country. I think as a nation, we have miles to go. The question of whether or not India is a developed or developing country is not so simple. To understand the real India, we need to look at many other indicators, such as health and education too. I think the level of development in a country is directly proportionate to the way we choose to treat our children, elderly and the disabled. As far as India is concerned, we might score very highly in terms of growth of physical infrastructure, but most of the public places are inaccessible to people with disabilities. As per the 2011 census, India has about 2.7 million people with disabilities, and only a handful of those enjoy education and/or employment. We are spending less than 4% of our GDP on important areas of education and health. Almost 12% of our children (between 5 and 15 years) are identified as child labor, and we have about 2.4 million people living with HIV/Aids. Almost 25% of my Indians are poor – in the same India where millions use smartphones. Within India, there are many different countries. There is no doubt that in some areas we are a developed country and, as far as people with disability are concerned, we have created facilities and a support system. But in many areas we still have long way to go. Now I leave it to you to decide whether you perceive India as developing or not! We have to focus on the â€Å"safety of women† and â€Å"corruption†. Corruption has mired growth to a great extent, and past and present governments have so far been unsuccessful in finding a permanent solution. The young Indian faces challenges stretching from a poorly administered education system to the lowest average wage rates in the world. The youth of India today lives in a society defined by multiple languages, religions, ethnicities and political thought, among other things. Yet they define their own generation, which is starkly d ifferent from their fathers and grandfathers. This puts them in a unique position to take their country towards positive growth and development.
